Terms of Service
These terms govern your use of The Stark SEO’s link building services. We’ve written them to be clear and straightforward — no legal fog, no hidden catches.
Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client”) and The Stark SEO (“we”, “us”, “our”) regarding access to and use of our link building, content placement, and related SEO services (“Services”).
Your continued engagement with our Services — including browsing our agency marketplace, submitting campaign details, approving publisher proposals, or making a payment — constitutes your ongoing acceptance of these Terms.
- Individual business owners purchasing link building directly for their own sites
- Digital marketing agencies purchasing on behalf of their clients under a white-label arrangement
- Resellers and freelancers who incorporate our services into their own packages
- Enterprise clients operating under a custom retainer or volume agreement
If you disagree with any part of these Terms, you should not place an order or use our Services. We are happy to answer questions before you commit — reach out via our website.
Description of Services
The Stark SEO provides white-label link building services to businesses and agencies worldwide. Our core offerings include guest posting, niche edit placements, and custom link building campaigns built around your target URLs, anchor text strategy, and publisher niche requirements.
We write original, E-E-A-T-compliant content and place it on third-party publisher websites that match your niche and domain metrics. Publishers are sourced from our vetted network of 500+ sites. You review and approve both the publisher and the content before anything is published.
We secure contextual link insertions within existing, indexed content on established third-party websites. These placements are permanent, relevance-matched, and delivered with full publisher metrics before approval.
High-volume clients may engage us under a bespoke retainer arrangement. The specific deliverables, timelines, and pricing for such campaigns are governed by a separate written agreement, which supplements these Terms.
All services are subject to publisher availability and niche match standards. We reserve the right to substitute a publisher of equal or superior quality where a pre-approved publisher becomes unavailable before publication.
Ordering & Campaign Approval
An order is initiated when you submit campaign details through our Agency Marketplace or directly to our team via email or a project brief. Submitting an order is not itself a binding commitment to pay — payment is only required after delivery, as outlined in Section 04.
For each placement, you must provide: the target URL, preferred anchor text (or range), niche/topic, and any publisher exclusions or requirements. Incomplete briefs may delay campaign commencement. We are not liable for delays caused by incomplete or late client submissions.
Before any work proceeds, we will present you with publisher options showing full Domain Rating, monthly organic traffic, niche relevance, and spam score data. Your written approval (email, dashboard, or message) of a publisher constitutes a binding commitment to pay for that placement upon live delivery.
For guest posting, you will receive the article draft for review before submission to the publisher. You may request one round of revisions at no additional cost. Approving the content locks the order — no further changes can be made once the article has been submitted to the publisher.
When Your Order Becomes Final
Your order is locked — and your payment obligation activated — at the point of publisher approval for niche edits, or content approval for guest posts. After the lock point, the placement is in the publishing pipeline and cannot be cancelled or modified without forfeiting payment.
Payment Terms
The Stark SEO operates on a pay-after-delivery model. You are invoiced only after we confirm that your link is live and verifiable on the publisher’s site. This model is a core part of our commitment to transparency.
Once a live URL has been confirmed and shared with you, an invoice will be issued. Payment is due within 7 calendar days of the invoice date unless a separate payment schedule has been agreed in writing for volume or retainer clients.
- Credit and debit cards via Stripe
- PayPal
- Bank transfer (for invoices above a threshold agreed in writing)
- Other methods as agreed for enterprise clients
Invoices not settled within the 7-day window may result in suspension of active campaigns and withholding of future publisher options until the balance is cleared. Persistent late payment may result in account termination under Section 11.
All prices are listed and invoiced in US Dollars (USD) unless otherwise specified. Clients paying in other currencies are responsible for any conversion fees or exchange rate differences applied by their payment provider.
What’s Included in the Price
- Publisher outreach and negotiation
- Original article writing (guest posts)
- Editorial submission and follow-up
- White-label delivery report
- 365-day link guarantee
Not Included
- Paid publisher fees above standard rates (quoted separately)
- Additional revision rounds beyond the first
- Rush delivery fees if requested
- Currency conversion charges
Client Responsibilities
Our ability to deliver quality placements on time depends on you meeting the following responsibilities. We’ve kept this list tight and practical.
You are responsible for providing accurate target URLs, anchor text guidance, and niche details. If a URL you provide is broken, penalised, or redirects in a way that affects the placement, we cannot be held responsible for any resulting impact on the link’s value.
Campaigns require your feedback at the publisher approval and content approval stages. Failure to respond within 14 business days of a prompt from our team may result in the campaign being paused. If non-responsiveness extends to 30 calendar days, the campaign may be closed without refund under the terms of our Refund Policy.
You may only use our Services to build links to websites and content that are legal, non-deceptive, and compliant with Google’s Webmaster Guidelines. You may not use our Services to promote:
- Adult, gambling, or pharmaceutical content without prior written disclosure and agreement
- Websites that facilitate illegal activity of any kind
- Content that is defamatory, misleading, or in violation of any applicable law
- Sites that have received a Google manual action or that are in active violation of Google’s spam policies
Agency clients who resell our services under their own brand are responsible for ensuring their end clients’ websites comply with the above. The Stark SEO does not communicate with or take instruction from end clients directly, and we will not be named in any deliverable without explicit written consent.
If you are unsure whether a website or niche is eligible for our services, ask us before placing an order. We would rather clarify upfront than have a campaign stall after work has begun.
Delivery, Timelines & Guarantee
We provide indicative delivery timelines at the point of ordering. These are estimates based on typical publisher turnaround times and are not contractual deadlines unless agreed in writing for a specific campaign.
- Niche edits: 2–7 business days from campaign brief confirmation
- Guest posts (Starter): 1–2 weeks from content approval
- Guest posts (Growth / Authority): 2–4 weeks from content approval
- Custom retainer campaigns: As specified in your written agreement
Publisher-side delays, editorial queues, and holiday periods can occasionally extend timelines. We communicate proactively when delays arise. We are not liable for indirect consequences of delayed delivery unless a guaranteed deadline was explicitly agreed in writing.
Your Links Are Protected for a Full Year
If any guest post link is removed from a publisher’s site within 365 days of going live, we will replace it with a link of equal or greater value at no cost. Niche edit placements are secured as permanent insertions and carry the same guarantee.
To activate a replacement, notify us within 14 days of discovering the removal. The guarantee does not cover removals caused by:
- Changes to your target URL or domain after publication
- Google penalties or manual actions against your website
- Requests from you to alter published content
- Publisher terms violations attributable to your website
Intellectual Property & Content Rights
All articles and content written by The Stark SEO as part of a guest posting campaign are created for the purpose of publication on third-party publisher sites. Once an article is published, ownership of the content transfers to the publisher as a condition of placement. The content cannot be republished elsewhere as this would create a duplicate content issue and potentially trigger the publisher to remove the original link.
Any materials you provide to us — brand guidelines, tone-of-voice documents, product descriptions, or specific copy — remain your intellectual property. By providing them, you grant The Stark SEO a limited licence to use them solely for the purpose of fulfilling your campaign brief.
Our publisher lists, outreach systems, pricing methodologies, and internal processes are proprietary. You may not attempt to reverse-engineer, replicate, or share any non-public operational details of our Service for the benefit of a competing business.
Campaign reports delivered to you are provided in a white-label format and contain no Stark SEO branding. You are free to present these reports to your clients under your own brand as you see fit.
We never contact your clients directly, never reveal that we are the fulfilment partner behind your campaigns, and our name never appears on any deliverable without your explicit written permission.
Confidentiality
Both parties may share information in the course of a campaign that is sensitive in nature — your client list, target URLs before launch, campaign strategy, or publisher pricing. Each party agrees to treat such information as confidential and not to disclose it to third parties without prior written consent.
- We will not share your client names, campaign details, or target URLs with any third party outside those necessary to fulfil the campaign (e.g. the publisher).
- We will not use your campaign data to benchmark or pitch competing services to your clients.
- Publisher identities disclosed to you as part of a campaign proposal are confidential and should not be used to circumvent our service and approach publishers directly.
Confidentiality obligations do not apply to information that is independently known to the receiving party, becomes publicly available through no fault of the receiving party, or is required to be disclosed by law or a court order.
Using publisher contact details shared with you during a campaign proposal to approach those publishers directly — bypassing our service — is a material breach of these Terms and may result in immediate account termination.
Warranties & Representations
- Services will be delivered using genuine manual outreach to real, independently-operated third-party publishers.
- All guest post content is original, written by human writers, and is not plagiarised, AI-spun, or duplicated from other sources at the time of publication.
- Publisher metrics (DR, traffic) presented to you for approval will be drawn from industry-standard tools (such as Ahrefs or SEMrush) and accurately represent data available at the time of the proposal.
- We do not use Private Blog Networks (PBNs), link farms, or any placement method that violates Google’s link spam policies.
- We do not warrant that any placement will result in specific ranking improvements, traffic increases, or revenue growth. SEO outcomes depend on many variables entirely outside our control.
- We do not warrant that a publisher site’s metrics (DR, traffic) will remain unchanged after publication. Publisher sites are independently operated and their metrics naturally fluctuate.
- We do not warrant that any link will pass a specific volume of PageRank, authority, or referral traffic.
- We do not warrant the stability of Google’s algorithms or the ongoing SEO value of any link-building strategy.
Our warranty is about the quality and authenticity of what we deliver — a real, live, contextual link on a real site with the metrics shown. What that link does for your rankings is a function of your broader SEO landscape and Google’s algorithm, not something any agency can honestly guarantee.
Limitation of Liability
To the fullest extent permitted by applicable law, The Stark SEO’s total aggregate liability to you for any and all claims arising out of or in connection with these Terms or the Services shall not exceed the total amount paid by you to us in the 3 months preceding the event giving rise to the claim.
In no event shall The Stark SEO be liable for any:
- Loss of revenue, profit, or anticipated savings
- Loss of rankings, organic traffic, or search engine visibility
- Loss of business opportunity or goodwill
- Indirect, consequential, or punitive damages of any nature
- Losses arising from Google algorithm updates, manual actions, or third-party platform changes
- Losses caused by information you provided that was inaccurate or incomplete
Nothing in these Terms limits or excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law in the applicable jurisdiction.
If your business is heavily reliant on a single campaign outcome, we strongly recommend discussing your expectations with us before ordering, so we can give you an honest assessment of what our services can and cannot deliver for your situation.
Termination & Account Suspension
You may stop using our Services at any time. Termination of your account does not release you from any payment obligations for placements that have already been approved or delivered. Please refer to our Refund Policy for details on what, if anything, may be recoverable.
We reserve the right to suspend or permanently terminate your access to our Services, with or without notice, if you:
- Breach any provision of these Terms, including misuse of publisher information or promotion of prohibited content
- Fail to settle outstanding invoices within the agreed payment window after reasonable follow-up
- File a chargeback in bad faith without first attempting resolution through our stated process
- Engage in any conduct that we reasonably believe damages the reputation or operations of The Stark SEO or our publisher network
Upon termination, all outstanding payment obligations remain in force. Any campaigns in progress at the time of termination may be completed at our discretion, with payment due upon delivery. We will not be obligated to continue or honour guarantee replacements for accounts terminated for cause.
Governing Law & Disputes
These Terms are governed by and construed in accordance with applicable commercial law. In the event of any dispute arising from or in connection with these Terms, the parties agree to attempt resolution through good-faith direct negotiation before pursuing any formal legal process.
Before initiating any formal dispute, you must notify us in writing describing the nature of the dispute and the outcome you are seeking. We will respond within 10 business days with a proposed resolution. Most disputes are resolved at this stage without the need for further escalation.
Where formal proceedings become necessary, both parties agree to submit to the exclusive jurisdiction of the courts competent for disputes of this nature based on the registered location of The Stark SEO’s principal operations, unless otherwise required by mandatory local law applicable to you as a consumer.
We have never needed formal legal proceedings with a client. Direct communication resolves disagreements far faster and better for everyone involved. Our preference is always a conversation first.
Amendments to These Terms
The Stark SEO reserves the right to update or amend these Terms at any time. We will update the effective date at the top of this page whenever material changes are made.
For clients with active retainer agreements, we will provide at least 14 days’ advance notice of any material changes by email. Your continued use of the Services following the effective date of any update constitutes acceptance of the revised Terms.
These Terms, together with our Refund Policy and any written campaign agreement or retainer contract, constitute the entire agreement between you and The Stark SEO with respect to the Services and supersede all prior communications, representations, or agreements, whether written or oral.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms on one occasion does not constitute a waiver of that right or provision on any future occasion.
